ShopItUp Canada — Listing Reporting and Copyright Notice Policy

Effective date: 2026-09-16 · Last updated: 2026-09-16

This Policy explains how to report listings, sellers, and content on the ShopItUp platform at shopitup.ca (the "Platform"), and how we handle those reports. It forms part of the ShopItUp Canada Terms of Service, Terms of Sale, and Seller Agreement, and it is the reporting process referred to in the Prohibited and Restricted Items Policy.

The Platform is operated by 2837675 Alberta Inc., an Alberta corporation carrying on business as ShopItUp ("ShopItUp," "we," "us"). ShopItUp Inc., a Delaware corporation, is a separate company that operates the ShopItUp platform in the United States under its own policies, and is not a party to reports made under this Policy.

ShopItUp does not pre-screen listings. Sellers ("Stores") are responsible for what they list. We rely on reports to help us find and act on problems. Anyone can make a report — you do not need an account, and you do not need to have bought anything.

1. How to report

What you are reporting How to report
Copyright infringement Send a copyright notice as described in Section 2 to support@shopitup.ca
Trademark infringement or counterfeit goods Email support@shopitup.ca (Section 4)
Stolen, unsafe, recalled, prohibited, or fraudulent listings, or a suspicious seller Use the Report this listing link on any listing, or the report form (Section 5)
Privacy concerns support@shopitup.ca (see our Privacy Policy)

Every listing carries a Report this listing link, and the report form can be used by anyone, with or without an account. Email is monitored during business hours.

If you believe someone is in immediate danger, contact your local emergency services first.

Reports about an order you placed are handled differently. Contact the Store first using the details in your order confirmation, and see Section 11 of the Terms of Sale if the Store does not resolve it.

2. Copyright: notice-and-notice under the Copyright Act (Canada)

Canada's Copyright Act uses a notice-and-notice system. When we receive a notice of claimed copyright infringement that meets the requirements below, we forward it to the affected Store and keep records, as the Act requires. We are not required by the Act to remove the content in response to a notice, and sending a notice does not by itself result in removal. ShopItUp may separately remove content under its own policies (Section 6).

2.1 What a notice must include

To be valid under section 41.25 of the Copyright Act, your notice must be in writing (electronic is acceptable) and must:

  1. state your name and address;
  2. identify the work or other subject-matter to which the claimed infringement relates;
  3. state your interest or right with respect to that work (for example, that you are the copyright owner or authorized to act for the owner);
  4. identify the material that is claimed to infringe, and its location, such as the listing URL;
  5. state the claimed infringement; and
  6. state the date and time of the claimed infringement.

Send it to support@shopitup.ca, or by mail to the address in Section 9.

If your notice does not contain this information, we may not be able to act on it, and we will tell you if we can.

2.2 What we do when we receive a valid notice

As required by section 41.26 of the Copyright Act, when we receive a notice that meets Section 2.1, we will:

  • forward the notice to the Store responsible for the identified listing, electronically and without delay; and
  • inform you that we have done so, or tell you why we could not (for example, that we could not locate the Store).

Forwarding a notice is not a finding that infringement occurred.

2.3 Records we keep

We will keep records that allow the identity of the affected Store to be determined, as the Copyright Act requires, for:

  • 6 months after we receive your notice; or
  • 1 year after we receive your notice, if you have started court proceedings relating to the claimed infringement and you notify us of that before the 6-month period ends.

2.4 What a notice cannot contain

Under the Copyright Act, a notice must not include:

  • an offer to settle the claimed infringement;
  • a request or demand for payment or for personal information; or
  • a reference or link to such an offer, request, or demand.

We may decline to forward a notice that contains any of these, or other content not permitted by the Act.

2.5 No fee

We do not charge a fee to forward a notice.

2.6 Fair dealing and honest notices

Some uses of a copyright-protected work are permitted under the Copyright Act, for example as fair dealing. Please consider whether an exception applies before sending a notice. A person who makes knowingly false claims may be responsible for resulting harm under applicable law, and we may stop accepting reports from them.

3. If you are a Store that received a notice

If we forward a copyright notice to you, it means someone has claimed that one of your listings infringes their copyright. Receiving a notice does not mean your listing has been removed, and it is not a court finding that you did anything wrong.

You should review the listing and the claim. If you believe the claim is mistaken, or that your use is permitted (for example, because you took your own photographs, or an exception applies), you may keep your listing up, and you may contact the person who sent the notice. If you are unsure of your rights, consider getting legal advice. The dispute is between you and the person who sent the notice — we are not able to decide who owns a right.

ShopItUp may separately remove a listing or take other action under its own policies and the Seller Agreement (Section 6), independently of the notice-and-notice process.

4. Trademark infringement and counterfeit goods

The notice-and-notice process covers copyright only. If you own a trademark and believe a listing infringes it or offers counterfeit goods, report it to support@shopitup.ca, including:

  1. your name and contact information, and your relationship to the trademark owner;
  2. the trademark, and its registration number and country, if registered;
  3. the listing URLs;
  4. an explanation of why each listing infringes or is counterfeit; and
  5. a statement that the information in your report is accurate and that you are the owner of the trademark or authorized to act for the owner.

We may remove listings, notify the Store and share your report with it, and suspend or close accounts. Stores may respond with evidence that the items are genuine or that the use is lawful. We may reinstate listings at our discretion.

5. Other reports

You can report listings or sellers that you believe:

  • offer stolen, counterfeit, unsafe, or recalled goods;
  • break our Prohibited and Restricted Items Policy, including recalled, unsafe, or banned products;
  • are fraudulent or misleading, including inaccurate condition, deceptive pricing, or fake reviews;
  • carry illegal content, hate propaganda, or content that promotes violence;
  • expose someone's personal information; or
  • involve suspicious seller activity.

How to report. Use the Report this listing link on the listing, or the report form. You can also email support@shopitup.ca.

Include:

  • the listing URL or Store name;
  • what you believe is wrong, and which part of our policies you believe it breaks;
  • any supporting information, such as photos, order numbers, or recall notices; and
  • how we can reach you, if you would like a reply.

What we do. We review reports and may remove listings, cancel orders and refund buyers from the Store's funds, hold payouts, suspend or close accounts, and refer matters to law enforcement, regulators, or Health Canada. We tell the Store what was removed and why, unless the law prevents us or we believe telling them would create a risk. We may not be able to tell you the outcome of every report.

Timing. We aim to review reports within 2 business days, and sooner where an item appears unsafe, recalled, or illegal.

We may decline reports that are duplicated, abusive, or made to harass a competitor.

6. Our rights

ShopItUp may, at its discretion and without liability to you, remove or disable listings, cancel orders (with a full refund to the buyer), or suspend or close Stores, in response to reports, under our policies and the Seller Agreement, or as required by law. We may act without advance notice where the law requires it or where we believe there is a risk to buyers or others. Removing or not removing a listing is not a legal finding about infringement or anything else. Nothing in this Policy requires ShopItUp to monitor the Platform.

7. If we acted on your listing

If we remove or hold back one of your listings, we will tell you which listing it was and why.

Ask for a review. If you believe the decision was wrong, reply to our message or contact us. If you are signed in, you can also use Feedback & support in the menu under your profile. Include anything that supports your position, such as proof of authenticity, a receipt, or certification.

Repeat infringers. We may suspend or close the accounts of Stores that repeatedly list infringing or prohibited items.

8. Privacy

We handle personal information in reports in accordance with our Privacy Policy. We share what is necessary with the affected Store, which means the Store may see the content of your report — for a copyright notice, the Copyright Act requires us to forward it. Tell us if you have a safety concern about being identified, and we will take it into account. We may be required to disclose a report, including your identity, where the law requires it.
